Terms of Service

1. Acceptance of Terms

By accessing or using RealVoiceover.com (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately. These Terms constitute a legally binding agreement between you ("User") and RealVoiceover regarding your use of the Platform and its services.

2. Platform Role and Scope

RealVoiceover operates exclusively as a portfolio showcase and talent discovery platform. We provide the technological infrastructure that enables voice artists to display their work and clients to discover and contact talent. RealVoiceover does not serve as an employer, agent, or contracting party for any voiceover projects. All project negotiations, pricing agreements, contractual terms, payments, and deliverables are arranged directly and independently between clients and voice artists. RealVoiceover does not commission, take fees from, or facilitate financial transactions for voiceover bookings made through the Platform.

3. Account Registration and Eligibility

To access certain features of the Platform, you must register for an account. You represent and warrant that all registration information you provide is accurate, current, and complete. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must immediately notify RealVoiceover of any unauthorized use of your account. The Platform is available only to individuals who are at least 18 years of age and can form legally binding contracts under applicable law.

4. Voice Artist Obligations

Voice artists creating profiles on RealVoiceover agree to: (a) provide accurate representations of their experience, skills, languages, and professional credentials; (b) only upload audio, video, images, and portfolio materials that they own or have obtained proper licensing and permissions to display; (c) maintain current and accurate portfolio information including availability, contact details, and service offerings; (d) respond to client inquiries in a timely and professional manner; (e) comply with all applicable laws regarding their voiceover services and business operations; and (f) not misrepresent their identity, credits, client relationships, or professional affiliations.

5. Client Obligations

Clients using the Platform agree to: (a) submit genuine project inquiries with accurate information regarding their identity, contact details, and project requirements; (b) provide clear project briefs including scope, usage rights, deadlines, and budget parameters where requested; (c) communicate respectfully and professionally with voice artists; (d) honor commitments made during project negotiations; and (e) not use the Platform for spam, solicitation, market research, competitive intelligence gathering, or any purpose other than legitimate voiceover talent discovery and hiring.

6. Prohibited Conduct

Users may not: (a) scrape, crawl, or harvest data from the Platform including profile information, contact details, or media samples; (b) create multiple accounts to circumvent restrictions or manipulate discovery; (c) upload malicious code, viruses, or harmful software; (d) impersonate any person or entity or falsely state an affiliation; (e) interfere with the proper functioning of the Platform; (f) use the Platform for any unlawful purpose or in violation of any applicable laws or regulations; or (g) attempt to gain unauthorized access to any part of the Platform, other user accounts, or connected systems.

7. Content Ownership and Licensing

Voice artists retain full ownership of all content they upload to their portfolios. By uploading content to the Platform, voice artists grant RealVoiceover a worldwide, non-exclusive, royalty-free license to display, host, and distribute the content for the purpose of operating and promoting the Platform. Clients retain ownership of all project information and materials they submit through inquiry forms. RealVoiceover does not claim ownership of any user-generated content.

8. Intellectual Property Rights

The Platform, including its design, logo, text, graphics, software, and underlying technology, is the exclusive property of RealVoiceover and is protected by copyright, trademark, and other intellectual property laws. Users may not reproduce, modify, distribute, or create derivative works of the Platform's proprietary elements without explicit written consent.

9. Content Moderation and Account Termination

RealVoiceover reserves the right, in its sole discretion, to: (a) review, modify, or remove any content uploaded to the Platform that violates these Terms or applicable law; (b) suspend, restrict, or terminate user accounts for conduct deemed harmful to the Platform, its users, or its reputation; (c) take appropriate legal action against users who violate these Terms. We reserve the right to cooperate fully with law enforcement authorities in investigating any illegal activity.

10. Limitation of Liability

To the maximum extent permitted by law, RealVoiceover shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Platform. This includes, without limitation, damages for lost profits, lost data, business interruption, or any other commercial losses or damages, even if RealVoiceover has been advised of the possibility of such damages. RealVoiceover's total liability for any claims arising under these Terms shall not exceed the amount paid by you, if any, for accessing the Platform.

11. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. RealVoiceover does not guarantee that the Platform will be uninterrupted, secure, error-free, or free of viruses. We do not endorse, guarantee, or assume responsibility for any content, services, or conduct of any voice artist or client using the Platform.

12. Third-Party Links and Services

The Platform may contain links to third-party websites or services that are not owned or controlled by RealVoiceover. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. Users access third-party links at their own risk.

13. Indemnification

You agree to indemnify, defend, and hold harmless RealVoiceover, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or in any way connected with: (a) your access to or use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Platform.

14. Modifications to Terms

RealVoiceover reserves the right to modify or replace these Terms at any time. Material changes will be communicated via the Platform or email. Continued use of the Platform after any modifications constitutes acceptance of the updated Terms. Users are encouraged to review these Terms periodically.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RealVoiceover operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of the Platform shall be resolved through binding arbitration or in the courts of that jurisdiction.

16. Entire Agreement

These Terms constitute the entire agreement between you and RealVoiceover regarding your use of the Platform and supersede all prior agreements and understandings, whether written or oral.
